The proposed budget includes allocating resources to establish a separate police force to protect the homes of the justices, a responsibility that is currently under the jurisdiction of the U.S. Marshals Service. The rationale behind this request is the identification of “evolving” risks faced by the nation’s top judicial body, necessitating a more robust security infrastructure to safeguard the Supreme Court and its members.
Justification for Increased Spending
The budget request, amounting to a total of $9.4 billion for the federal judiciary and the Supreme Court in the upcoming fiscal year, highlights the need for heightened security measures due to the dynamic nature of the threats faced by the justices and the institution as a whole. As per the proposal, $5.8 million will be allocated to expand the activities of the Supreme Court Police, the internal security force of the court, while $13.6 million will be designated to enable the court’s police force to assume the responsibility of protecting the justices’ residences, a duty currently fulfilled by the U.S. Marshals Service.
The escalating risks and challenges confronting the judiciary are underscored by a series of threat assessments that necessitate ongoing protection for the Supreme Court. The judiciary is aiming to enhance its security posture in response to a surge in threats against federal judges, with serious threats increasing from 224 in fiscal year 2021 to 457 in fiscal year 2023, as reported by the U.S. Marshals Service. In 2022, legislation was passed to extend police protection to the families of the justices and senior court officials following incidents such as the leak of a draft ruling overturning the Roe v. Instances of direct threats against justices, such as the attempted assassination of Justice Brett Kavanaugh by an armed individual in California, further emphasize the need for enhanced security protocols.
